Journal Spécial des Sociétés | How are companies preparing for the new regulations on due diligence?

Maxime de Guillenchmidt, partner and Julie Guenand, associate spoke to the “Journal Spécial des Sociétés” about the entry into effect of the European directive known as “CS3D”.

The directive  harmonizes the national legislation of member states in terms of duty of care and thus obliges some 6,000 companies across the European Union to implement a due diligence plan.

While companies have already been preparing for this since the 2017 French law dedicated to the same subject, the implementation of the directive is no less seriously taken, with the legal risk becoming more concrete and the reputational risk amplified.

Ultimately, in their view, this could lead to an increase in commercial litigation, motivated by non-compliance with the duty of diligence.
