Ouest France | Indictment in the RN trial: what is a “provisional sentence”?

Thomas Amico, white-collar law partner at Veil Jourde, spoke to Ouest-France about the notion of “provisional execution” of the ineligibility sentence, demanded in the prosecutor’s indictment in the so-called “Front national MEP assistants” case.

He explained that, unlike civil procedure, criminal procedure does not provide a mechanism for suspending the provisional execution of a criminal decision. As for the mandatory additional penalty of ineligibility required of defendants, Thomas pointed out that judges can always waive it, depending on the context of the offence and the personality of the perpetrator.
