Commercial Dispute Resolution : Shockwaves in France as privilege legislation removed from Bill

In Rob Harkavy”s article for Commercial Dispute Resolution (CDR), Maxime Seno comments on the state of play after the censorship of the “legal privilege” by the France Constitutional court on November 16.

He underlines that the debate – which will return – is far from being closed and that opinions on this controversial measure remain divergent, even within the legal world: while the National Bar Council – lawyers is not partisan of the measure, considering that this would tend to weaken the professional secrecy of lawyers,

 “On the contrary, certain organizations of legal professionals believe that its recognition would constitute a major advance for the state of law, would contribute to the good administration of justice and would strengthen the protection of French economic sovereignty.”
