Advising a wide range of clients on public and regulatory law issues in connection with their projects and disputes
Our team regularly advises private and public-sector players operating in highly regulated sectors (education, energy, banking & insurance, agri-food, health, etc.), in connection with the application of sector-specific regulations, during administrative inspections or with a view to securing their positions and projects involving a regulatory dimension.
In addition, our team is a member of the A-CAP association (Avocats – Conseils en Affaires Publiques – Lawyers and Advisers on Public Affairs), and thus assists its clients in the institutional relations to be envisaged to accompany the evolution of the norm, in parallel with our strong practice in matters of priority preliminary rulings on constitutionality.
Our team is also frequently called upon to provide support for major public-private projects, particularly in the field of public procurement (concessions, PPPs – Public-Private Partnerships, complex contracts, public contracts), as part of the deployment of commercial and purchasing strategies, the structuring of responses to calls for tender and contract management, and lastly in the context of public procurement (pre-)litigation (award and performance, management of settlements and amendments, etc.).
Our team is also frequently called upon to support major development projects (regulatory procedures, management of permits and ICPE – Installations Classified for the Protection of the Environment, ZACs – Urban Development Zones and development concessions, etc.).
Finally, our team is involved in matters of (para)public governance (mixed economy, interventions on the competitive market, reorganisation, outsourcing and spinning-off of services or activities), and can be called upon to deal with compliance issues applied to the public sector (CRC inspections – monitoring of compliance with construction rules, Sapin II, illegal taking of interests, etc.).
